Terms of Use

1 Background

1.1 We are the owner and operator of this Site.

1.2 By using the Site, you (the user) agree to be bound by these Terms of Use. Your use of the Site indicates your acceptance of these Terms of Use.

1.3 Please read these Terms of Use carefully before you begin using the Site.

2 Modifications to Site

2.1 We reserve the right to change, modify, add, remove, correct or update the Site, any data contained within the Site, or amend these Terms of Use at any time without notice.

2.2 All changes are effective from the date they are posted.

2.3 Your continued use of the Site will be acceptance of any amended Terms of Use.

2.4 It is your responsibility to ensure you are aware of any changes to these Terms of Use each time you visit or use the Site.

3 Limitations on use

3.1 You must:

(a) not copy, transmit, distribute, reproduce, licence, alter, reverse engineer, adapt or modify the whole or any part of the Site in any way whatsoever;

(b) not use the Site in an unlawful way, for any unlawful purpose, or in any manner inconsistent with this Agreement;

(c) not insert malicious code, destroy data (including through the deliberate or accidental installation of viruses) or allow other harmful data to be installed on the Site;

(d) not use the Site in any way that could damage, disable, overburden, impair or compromise our server or any of our operating systems; and

(e) comply with any applicable law and regulation relating to downloading or uploading of information to or from, or the use of technology which supports the use of the Site.

4 Data security

4.1 The transmission of information over the internet is not completely secure or error free. In particular, emails to or from us and information submitted to us through the Site may not be secure. You should use your discretion in deciding what information you should send via these means.

4.2 Emails to and from us may undergo email filtering and virus scanning, including by contractors and subcontractors. We do not warrant that such filters and scans will be effective in removing viruses or other potentially harmful codes.

5 Password secrecy

5.1 We may issue you with a username and password to enable you to access particular features on our Site. You:

(a) must keep the details of any username and password confidential; and

(b) are fully responsible for their misuse if you do not do so.

6 Linking and framing

6.1 The Site may contain links to other websites and may display content or information from other websites within the frames on the Site which:

(a) belongs to third parties; and

(b) contains content that is not controlled by us.

6.2 Unless specifically stated we:

(a) do not approve, endorse, recommend or sponsor linked websites, their owners or operators, or any information, graphics, materials, products or services referred to, or contained on those linked websites for any purpose;

(b) are not responsible or liable for the content of such information; and

(c) provide no warranty as to the accuracy, currency or suitability of such information for any purpose.

6.3 Unless specifically stated the appearance of links on the Site does not indicate any relationship between us and

any third party.

6.4 We exclude liability for any loss suffered as a result of:

(a) use of these third party websites; or

(b) reliance on the information contained within third party websites.

6.5 Any terms of use and privacy policies for those third party websites will govern your use of those websites.

6.6 It might also be the case that the Site enables you to link information to it. If you do, you agree that any content or

information linked to the Site will not be misleading or deceptive.

7 Posting comments

7.1 The Site may enable you to post comments (for example, on blogs, forums or other public areas). You are

responsible for all comments that you post, or that are posted using your username and password.

7.2 You must not post any comment that:

(a) is unlawful or obscene;

(b) intentionally or unintentionally amounts to intimidation or harassment;

(c) is discriminatory, defamatory, inflammatory, threatening or profane;

(d) is sexually-oriented or contains sexual references; or

(e) violates or infringes another person's rights (including rights of privacy and publicity, and Intellectual

Property rights).

8 Copyright and other Intellectual Property

8.1 The Site is protected by copyright and other material that contains Intellectual Property rights that are owned by or

licensed to us.

8.2 Subject to a contrary intention being specified in specific parts of the contents of the Ste, you may only download

and print content from the Site for your own personal use or for our use or benefit (including for the internal

administration of our organisation or its branches).

8.3 You must not publish, adapt, communicate with the public, distribute to third parties, amend or make any copy of

any part of the content of the Site without our prior written consent.

8.4 All other Intellectual Property rights which subsist in the contents of the Site belong to us or our licensors,

advertisers or affiliates.

8.5 In using the Site, you must not do anything that interferes with, or breaches the Intellectual Property rights of any

third party.

9 Privacy and Personal Information

9.1 You agree that we may collect, use and deal with your Personal Information in accordance with and as

contemplated by our Privacy Policy.

10 Cookies

10.1 We may use cookies to identify your computer on our server so we can track your use of the Site. In some

instances, these cookies may collect and store personal information about you which will only be used in

accordance with our Privacy Policy.

11 Downloadable material

11.1 We make downloadable documents, software and other materials available under the following conditions:

(a) downloadable material within the Site is provided on the basis that you will conduct virus scanning and

other checks to protect:

(i) your data;

(ii) any hardware, mobile device or software used to access the data; and

(iii) the data, hardware, mobile device or software of any other person with whom you transmit

downloaded material to;

(b) we will not be liable for any loss, injury or damage however caused (including by negligence) that arises in

any way from the use of downloaded material; and

(c) if you provide the downloaded material to another party you agree to bring the Terms of Use to the other

party's attention.

12 Your risk

12.1 You access the Site at your own risk.

12.2 We accept no responsibility for any interference, loss, damage or disruption to your hardware, mobile device,

software or data, or which otherwise arises in connection with your use of the Site.

12.3 You must take your own precautions to ensure that the process you employ to obtain access to the Site does not

expose you to the risk of:

(a) viruses;

(b) malicious computer code; or

(c) other interferences,

that may cause damage, loss or corruption to any device used to view or use the Site.

13 Software viruses

13.1 Without limiting the above, we do not warrant that any information or other material that is available for download

is free from viruses or other conditions that could damage or interfere with:

(a) your hardware, mobile device, software or data; or

(b) the hardware, mobile device, software or data of any third party with whom you transmit information to.

13.2 To the fullest extent possible, we exclude liability for any loss suffered as a result of any such viruses or defects.

14 Liability

14.1 To the fullest extent permitted by law, we will not be liable to any person or entity for any direct, indirect or

consequential loss arising under any theory of liability (including by way of negligence) and which arises in

connection with:

(a) the use of the Site; or

(b) the reliance on any information on the Site including any publications contained on, or linked to or from the

Site by any third party.

14.2 We do not provide any warranty in relation to your use of the Site as to the currency, completeness or accuracy of

information contained in the Site.

14.3 The Site and its contents are provided entirely on an "as is" basis. We exclude all implied conditions and

warranties with respect to the Site and its content, but excluding any implied condition or warranty which by law

cannot be excluded.

14.4 If any law implies a condition or warranty which by law cannot be excluded, then to the fullest extent permitted by

law, our liability for any breaching the condition or warranty will be limited to:

(a) the supply of the relevant goods and services again; or

(b) payment of the cost of having the relevant goods and services re-supplied.

14.5 For all other loss for which we may become liable and to which clause 14.4 does not apply, our total liability will

be limited to the aggregate amount of $1.00.

15 Assignment

15.1 We may assign any of our rights, title, interest or obligations subsisting under these Terms of Use or in the Site to

any third party without your consent.

16 Severability

16.1 If anything in these Terms of Use is determined to be invalid, unlawful or unenforceable for any reason, then to

the full extent permitted by law:

(a) the offending provision will be severed from the rest of the Terms of Use; and

(b) the rest of the Terms of Use will continue to be valid and enforceable.

17 Applicable Law

17.1 These Terms of Use along with your use of the Site are governed by the laws of Queensland, Australia, and you

unconditionally submit to the jurisdiction of the courts and tribunals in that State.

18 Definitions

18.1 Intellectual Property: means all registered and unregistered rights in Australia and throughout the world for the

following (but excluding Moral Rights):

(a) copyright;

(b) trademarks or service marks;

(c) designs;

(d) patents;

(e) semiconductors or circuit layouts;

(f) source codes and object codes;

(g) trade, business or company names;

(h) indications of source or appellations of origin;

(i) trade secrets;

(j) know-how and confidential information;

(k) the rights to registration of any of the above; and

(l) the right to bring an action for infringement of any of the above.

18.2 Moral Rights: means the moral rights conferred under the Copyright Act 1968, including the right of integrity of

authorship, the right of attribution of authorship and the right not to have authorship falsely attributed, and the

equivalent rights elsewhere in the world.

18.3 Personal Information: has the meaning given to it in our Privacy Policy.

18.4 Privacy Policy: means our privacy policy (as amended from time to time) which can by following the link at the

bottom of the homepage of the Site.

18.5 Site: means our website at www.qcwa.org.au, as amended from time to time.

18.6 We, us or our: refers to The Queensland Country Women's Association.

18.7 You or your: means you, the user of the Site.
